Terms of Service

These terms are currently under review by legal counsel. Final terms will be published prior to product launch.

1. Acceptance of Terms

By accessing or using any services provided by Pidgeon Health (“Company,” “we,” “us,” or “our”), including the Pidgeon Health website at pidgeon.health, the Post CLI tool, the Post Console application, the Loft observability platform, and the Flock synthetic population engine (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Services.

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Services

Pidgeon Health provides healthcare interoperability testing, monitoring, and synthetic data generation tools:

  • Post CLI (Free Tier): Open-source command-line tool for generating, validating, and de-identifying HL7, FHIR, and NCPDP test messages.
  • Post Console (Pro Tier): Web-based graphical interface with enhanced generation, workflow orchestration, AI-assisted triage, vendor profile management, and HTML reporting.
  • Loft (Enterprise Tier): Interface traffic monitoring, alerting, analytics, and self-healing capabilities for production healthcare environments.
  • Flock (Pro/Enterprise Tier): Schema-aware synthetic patient population generation engine for database seeding and testing.

3. Account Registration and Security

Certain features require account registration. You agree to provide accurate information, maintain the confidentiality of your credentials, and promptly notify us of any unauthorized access. You are responsible for all activity under your account.

4. Subscription and Payment Terms

Paid Services are billed on a monthly or annual basis as selected at subscription. All fees are in U.S. dollars and are non-refundable except as required by law. We may change pricing with 30 days' notice. Founding member pricing, where offered, is locked for the lifetime of continuous subscription.

Free tier access does not require payment. Upgrading to paid tiers requires a valid payment method. Failure to pay may result in suspension or termination of paid features.

5. Acceptable Use

You agree not to:

  • Use the Services to process, store, or transmit actual Protected Health Information (PHI) without appropriate authorization and safeguards.
  • Reverse engineer, decompile, or disassemble any part of the Services beyond what is permitted by applicable law.
  • Attempt to gain unauthorized access to any part of the Services or related systems.
  • Use the Services to develop a competing product or service.
  • Violate any applicable law, regulation, or third-party rights.
  • Share credentials or circumvent usage limits, feature gating, or licensing restrictions.

6. Intellectual Property

The Post CLI is licensed under the Mozilla Public License 2.0 (MPL 2.0). All other Services, including the Console, Loft, and Flock, are proprietary. You retain ownership of your data and configurations. We retain ownership of the Services, including all software, algorithms, documentation, and brand assets.

7. Data and Privacy

Our collection and use of personal data is described in our Privacy Policy. The Services are designed to work with synthetic and de-identified data. You are solely responsible for ensuring that any data you provide complies with applicable healthcare privacy regulations, including HIPAA.

8. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. SYNTHETIC DATA GENERATED BY THE SERVICES IS NOT INTENDED FOR CLINICAL USE AND SHOULD NOT BE USED IN PRODUCTION HEALTHCARE SYSTEMS WITHOUT APPROPRIATE REVIEW.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIDGEON HEALTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Termination

Either party may terminate at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use paid Services ceases. You may export your data prior to termination. Free CLI access under the MPL 2.0 license is not affected by account termination.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or prominent notice on the Services. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any disputes shall be resolved in the courts located in Delaware.
